Website means the Parmalat "Milk The Rewards" website.
Parmalat means Parmalat Australia Ltd (ABN 56 072 928 879) in Queensland, New South Wales, South Australia, Northern Territory and Victoria and Harvey Fresh (1994) Ltd (ABN 15 065 591 219) in Western Australia.
Points means the points awarded to the Customer based on the "literage" of Parmalat flavoured milk purchased by the Customer during the Promotional Period;
Promotional Period means the period commencing on 01.01.2018 and expiring on 31.10.2019.
Reward Program means the Parmalat "Milk The Rewards" School Reward
Program operating during the Promotional Period;
Rewards means the items described on the Parmalat "Milk the Rewards" website;
School Term means, for customers based in Queensland, the official Government school terms as published at www.education.qld.gov.au, for customers based in Victoria, the official government school terms as published at www.vic.gov.au for South Australia www.decs.sa.gov.au for New South Wales www.schools.nsw.edu.au and for Western Australia at www.education.wa.edu.au
TERMS AND CONDITIONS
By registering for the Rewards Program the customer accepts these terms and conditions.
HOW TO ACCRUE POINTS AND CLAIM REWARDS
The Parmalat Reward Program is open to school based customers of Parmalat who are invited to participate (hereafter referred to as "you", "customer" or "eligible school" as the case requires).
Points will be awarded to a participating customer on the following basis:
- For each litre or kilogram of Parmalat products purchased and paid for by the customer during the Promotional Period Parmalat will award the customer ten (10) Points.
- Progress reports of Points accrued by the customer will be provided by Parmalat at the beginning of each School Term during the Promotional Period.
In some circumstances, Customers may be able to form groups and pool their Points.
This is subject to Parmalat's approval and is at Parmalat's sole discretion. Where a Customer is part of a grouped school and leaves the group (changes groups or drops out of the group) the Customer must advise Parmalat in writing that it is no longer a member of that group. Notification will take effect on the date it is received in writing by Parmalat, or on the date the Customer ceased to be a member of the group, whichever is the latter ("Notification Date"). All Points accrued by that Customer prior to the Notification Date will be allocated to the group the Customer previously belonged to, and all Points accrued to the Customer following the Notification Date will be allocated as directed by the Customer in accordance with the terms of the program (i.e. to the Customer where the Customer is still eligible, or to a new group, where that group is eligible).
Customers will be able to view their points and prizes online at www.parmalat.com.au/Loyalty and register to place a claim. In order to qualify for a Reward you must earn a minimum of 500 points during the Promotional Period. You may only claim Rewards equal to the total value of all the Points as indicated on www.parmalat.com.au/Loyalty you must choose your desired Rewards from the website.
Only Parmalat, or its authorised representatives, can supply and invoice the nominated Parmalat flavoured milk products that are the subject of the Reward Program, and issue Points and supply Rewards. All Parmalat flavoured milk products must be paid for in full and in accordance with your Parmalat trading terms before Points will accrue or Rewards can be claimed.
Points can be redeemed for rewards from 01.01.2018 through to 31.10.2019.
Points cannot be redeemed at any time outside the Promotional Period. Claim Forms must be completed and submitted during the Promotional Period. Points that are not redeemed during the Promotional Period will be forfeited.
Parmalat do not provide any advice or give any warranty in relation to the taxation implications arising from any Rewards that you become entitled to under the Reward Program. All Rewards are valued inclusive of GST. No taxation liability is accepted by Parmalat and we recommend that you obtain independent advice on your taxation position.
AUTHORITY TO RECEIVE REWARDS
All Rewards are issued on the understanding that the person claiming the Rewards has been authorised to do so on behalf of the participating eligible school. Nevertheless, Rewards claimed by eligible schools are subject to relevant legislation in the various States and Territories of Australia in which they operate, and it is up to the customer to ensure that Rewards must be paid out in a manner consistent with that legislation.
Parmalat does not accept any liability in respect to loss, damage, death or injury, including consequential loss or damage arising from the supply of a Reward, use of the Reward, or from the loss, theft or destruction of a Reward except for any liability which cannot be excluded by law. You may have some rights under the Competition and Consumer Act and there may also be some warranties implied by law which cannot be excluded, subject to these rights and implied warranties, Parmalat give no warranty with respect to the quality of the Rewards or their suitability or fitness for any purpose.
RIGHT TO AMEND PROGRAM
If for any reason any aspect of the Reward Program is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Reward Program, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Reward Program, vary these Terms and Conditions or invalidate any affected claims.
To the extent permitted by law, Parmalat will not be liable for any loss or damage suffered which may result from any cancellation, modification, suspension, variation or changes to the Reward Program made by Parmalat in accordance with these Terms and Conditions. All decisions pertaining to any disputes under the Reward Program or on the interpretation of these Terms and Conditions will be made by Parmalat whose decision will be final and binding on all customers.
Except as otherwise set out in these terms and conditions, any agreement, covenant, representation or warranty by Parmalat only binds the Parmalat entity in the state or territory specified Parmalat Australia Ltd in Queensland, New South Wales, South Australia, Northern Territory and Victoria and Harvey Fresh (1994) Ltd in Western Australia, and binds each of them individually. Parmalat's liability is severable, not joint liability.
If the customer is at any time during the continuance of the Reward Program in breach of its trading terms, with Parmalat or with any Parmalat franchisees or vendors, Parmalat may cancel the customer's registration and their participation in the Program. To the extent permitted by law, Parmalat will not be liable for any loss or damage suffered which may result from any cancellation, modification, suspension, variation or changes made to the customer's registration and/or participation and/or account in the Rewards Program as a consequence of the customer being in breach of the trading terms or the terms and conditions of the Reward program.
EXCLUSION OR CANCELLATION
Parmalat reserve the right at their absolute discretion at any time to exclude any customer from inclusion in the Reward Program or to cancel the registration of any customer in the Reward Program.
Rewards will not be available until all claims are validated by a Parmalat representative. Further, Rewards are not transferable or redeemable for cash.
All Rewards are based on descriptions from information received from suppliers and manufacturers. Unless otherwise stated, installation and/or service of Rewards are not included. However, guarantees provided by manufacturers may still apply.
Discontinued or unavailable Rewards may be substituted by Parmalat with a reward of similar value at their absolute discretion. Fluctuations in the Australian dollar may result in prices changing for products and Parmalat reserves the right to adjust Rewards point values accordingly which may result in points values varying between printed catalogues and the website.
Any enquiries concerning warranty information applying to Rewards should be directed to the manufacturer. Parmalat recommends that you complete and forward the warranty information card contained with any Reward in accordance with the manufacturer's instructions.
All details provided by the qualifying customer will be stored at the registered office of Parmalat at Level 5, 35 Boundary Street, South Brisbane, Queensland 4101. Any request to access, update or correct any information should be directed to the 'Privacy Officer' at this address. By ticking the opt-in box below each customer consents to the information which they submit with their Rewards claim being entered into a database and for Parmalat and their promotional partners to use this information for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the qualifying customer.
These Terms and Conditions are the entire agreement between Parmalat and the customer unless otherwise altered by Parmalat in accordance with these Terms and Conditions.
